The most significant change is the introduction of financial consequences for perpetrators of family violence.<\/p>\n\n\n\n<p><br>The key changes to family law legislation from 10 June 2025 are:<\/p>\n\n\n\n<ol class=\"wp-block-list jds-decimal\">\n<li style=\"font-style:normal;font-weight:700\"><strong>Family violence will be a relevant factor when deciding property settlements and spousal maintenance<\/strong><\/li>\n<\/ol>\n\n\n\n<p>The changes will insert new sections into the Family Law Act, requiring a Court to consider the impact of any family violence or economic or financial abuse when deciding on a property settlement or the payment of spousal maintenance.<br><\/p>\n\n\n\n<p><br>In particular the Court will need to consider:<br><br><\/p>\n\n\n\n<ul class=\"wp-block-list jds-p0\">\n<li class=\"jds-p30\">whether family violence has affected a partner\u2019s ability to contribute financially or non-financially during the relationship<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list jds-p0\">\n<li class=\"jds-p30\">whether family violence will have an impact on a partner\u2019s current and future circumstances.<\/li>\n<\/ul>\n\n\n\n<p>Prior to the changes, family violence has been a consideration in property settlements in only very narrow circumstances. This has meant that it has rarely impacted outcomes. The new legislation therefore represents a significant change.<\/p>\n\n\n\n<ol start=\"2\" style=\"font-style:normal;font-weight:700\" class=\"wp-block-list jds-p0\">\n<li class=\"jds-p0\"><strong>Wastage, liabilities and housing needs will also be relevant factors when deciding property settlements<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Although previously open to the Court to consider when deciding a property settlement, wastage, liabilities and housing needs will become specific factors for the Court to consider in property settlements.<\/p>\n\n\n\n<p><br>In relation to wastage, when considering each party\u2019s contributions, the Court will need to consider whether one person has intentionally or recklessly lost or given away assets or financial resources, during or after the relationship.<\/p>\n\n\n\n<p><br>In relation to liabilities, the Court will be able to consider the nature of the liabilities, the circumstances that brought about those liabilities and the impact on those liabilities on the financial future of the parties.<\/p>\n\n\n\n<p><br>In relation to housing needs, the Court will need to give additional consideration to the need for either partner to provide appropriate housing for a child. &nbsp;<\/p>\n\n\n\n<ol start=\"3\" style=\"font-style:normal;font-weight:700\" class=\"wp-block-list jds-p0\">\n<li class=\"jds-p0\"><strong>The list of examples of family violence will be expanded<\/strong><\/li>\n<\/ol>\n\n\n\n<p>The examples of economic and financial abuse set out in the Family Law Act will be expanded to include a broader range of coercive and controlling behaviours. Those behaviours include:<\/p>\n\n\n\n<ol style=\"list-style-type:lower-alpha\" class=\"wp-block-list jds-p0\">\n<li class=\"jds-p0\">Controlling a partner\u2019s assets or money.<\/li>\n<\/ol>\n\n\n\n<ol start=\"2\" style=\"list-style-type:lower-alpha\" class=\"wp-block-list\">\n<li class=\"jds-p0\">Using deception or pressure to force a partner to take on debts.<\/li>\n<\/ol>\n\n\n\n<ol start=\"3\" style=\"list-style-type:lower-alpha\" class=\"wp-block-list\">\n<li>Interfering with a partner\u2019s work, such as<\/li>\n<\/ol>\n\n\n\n<ol style=\"list-style-type:lower-roman\" class=\"wp-block-list\">\n<li class=\"jds-p15\">Sabotaging job opportunities<\/li>\n<\/ol>\n\n\n\n<ol start=\"2\" style=\"list-style-type:lower-roman\" class=\"wp-block-list jds-p15\">\n<li class=\"jds-p15\">Preventing a partner from pursing work or education.<\/li>\n<\/ol>\n\n\n\n<ol start=\"4\" style=\"list-style-type:lower-alpha\" class=\"wp-block-list jds-p0\">\n<li class=\"jds-p0\">Using pressure or deception to manipulate a partner in relation to government payments.<\/li>\n<\/ol>\n\n\n\n<ol start=\"5\" style=\"list-style-type:lower-alpha\" class=\"wp-block-list jds-p0\">\n<li class=\"jds-p0\">Dictating how much a partner can spend on necessities.<\/li>\n<\/ol>\n\n\n\n<ol start=\"6\" style=\"list-style-type:lower-alpha\" class=\"wp-block-list jds-p0\">\n<li class=\"jds-p0\">Denying a partner access to financial resources for necessities.<\/li>\n<\/ol>\n\n\n\n<ol start=\"7\" style=\"list-style-type:lower-alpha\" class=\"wp-block-list jds-p0\">\n<li class=\"jds-p0\">Cutting a partner off financially as a form of punishment.<\/li>\n<\/ol>\n\n\n\n<ol start=\"8\" style=\"list-style-type:lower-alpha\" class=\"wp-block-list\">\n<li class=\"jds-p0\">Pressuring a partner to enter into legal contracts or change their Will.<\/li>\n<\/ol>\n\n\n\n<ol start=\"9\" style=\"list-style-type:lower-alpha\" class=\"wp-block-list\">\n<li class=\"jds-p0\">Witholding child support as a means of pressure or punishment of a partner.<\/li>\n<\/ol>\n\n\n\n<ol start=\"10\" style=\"list-style-type:lower-alpha\" class=\"wp-block-list\">\n<li class=\"jds-p0\">In relation to dowries:<\/li>\n<\/ol>\n\n\n\n<ol start=\"1\" style=\"list-style-type:lower-roman\" class=\"wp-block-list jds-p15\">\n<li class=\"jds-p15\">Forcing a person to provide money or assets as a dowry.<\/li>\n<\/ol>\n\n\n\n<ol start=\"2\" style=\"list-style-type:lower-roman\" class=\"wp-block-list jds-p15\">\n<li class=\"jds-p15\">Concealing actions of agreements in relation to a dowry.<\/li>\n<\/ol>\n\n\n\n<ol start=\"4\" style=\"font-style:normal;font-weight:700\" class=\"wp-block-list\">\n<li>The Court&#8217;s approach to determining property settlements will be expanded upon in the legislation<\/li>\n<\/ol>\n\n\n\n<p>The legislation will require the Court to identify the parties\u2019 legal and equitable rights in property and the parties\u2019 existing liabilities. At present the Court and parties do this, but under the new legislation, this will be specifically required.<br><br>The legislation also re-names what was colloquially referred to as \u201cfuture needs\u201d factors as \u201ccurrent and future circumstances\u201d.<\/p>\n\n\n\n<p><br>The effect of the legislation will be that, in considering what order (if any) is just and equitable, the Court will need to:<\/p>\n\n\n\n<p class=\"jds-p0\"><br>Identify the property and liabilities of the parties or of either of the parties<br><br><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"jds-p0\">Identify the property and liabilities of the parties or of either of the parties<br><br><\/li>\n\n\n\n<li class=\"jds-p0 \">Take into account:<br><br>\n<ul class=\"wp-block-list\">\n<li class=\"jds-p0 jds-circle \"><span style=\"color: initial;\">The considerations in relation to contributions, and<\/span><br><br><\/li>\n\n\n\n<li class=\"jds-p0 jds-circle \">The considerations in relation to current and future circumstances.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p>In essence, this is not dissimilar to the process currently followed by the Court, although there is an expanded list of contributions considerations (including family violence) and current and future circumstances considerations (including family violence).<\/p>\n\n\n\n<ol start=\"5\" style=\"font-style:normal;font-weight:700\" class=\"wp-block-list\">\n<li class=\"jds-p0\"><strong>There will be greater recognition of the importance of pets<\/strong><\/li>\n<\/ol>\n\n\n\n<p>For more information about the important changes concerning pets, see the insight from Karen Devey, Senior Associate at Blackwood Family Lawyers at <a href=\"https:\/\/www.blackwoodfamilylawyers.com.au\/insights\/pet-custody-in-family-law-changes-are-coming\/\">https:\/\/www.blackwoodfamilylawyers.com.au\/insights\/pet-custody-in-family-law-changes-are-coming\/<\/a><\/p>\n\n\n\n<ol start=\"6\" style=\"font-style:normal;font-weight:700\" class=\"wp-block-list\">\n<li class=\"jds-p0\"><strong>The Court\u2019s less adversarial approach to trials will be extended to property matters<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Previously only applied to parenting matters, the Court will be able to take a less adversarial approach to trials about property and financial matters.<\/p>\n\n\n\n<p><br>This will give the Court more flexibility in managing how proceedings are run, for instance by permitting technology to facilitate remote attendance where there are allegations of family violence.<\/p>\n\n\n\n<ol start=\"7\" style=\"font-style:normal;font-weight:700\" class=\"wp-block-list\">\n<li class=\"jds-p0\"><strong>Obligations to make full financial disclosure will be given greater importance<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Each person\u2019s obligation to fully disclose their financial circumstances will be detailed in the Family Law Act, instead of in the Court Rules. This likely signals a greater emphasis from the Court on parties complying with their obligations about disclosure and consequences if they fail to do so.<\/p>\n\n\n\n<ol start=\"8\" style=\"font-style:normal;font-weight:700\" class=\"wp-block-list jds-p15\">\n<li class=\"jds-p0\"><strong>Children\u2019s Contact Services will be regulated<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Some parents need the assistance of independent organisations to facilitate changeovers or supervise children\u2019s time with a parent.
