In <a href=\"https:\/\/www.blackwoodfamilylawyers.com.au\/property-settlements.htm\" type=\"link\" id=\"https:\/\/www.blackwoodfamilylawyers.com.au\/property-settlements.htm\">financial matters<\/a>, parties must provide full and frank disclosure of their financial circumstances.\u00a0<br><br><\/p>\n\n\n\n<p>Rule 6.01 of the Federal Circuit and Family Court of Australia (Family Law) Rules 2021 (<strong>Rules<\/strong>) imposes a duty on parties to provide full and frank disclosure of all information relevant to the proceeding, in a timely manner. This duty extends to the Federal Circuit and Family Court of Australia (<strong>Court<\/strong>) and the other parties to the proceedings. This duty not only applies while Court proceedings are on foot but also where family law negotiations are taking place.<br><br><\/p>\n\n\n\n<p><strong><em>What if the other party is not disclosing assets?<\/em><\/strong><br><br><\/p>\n\n\n\n<p>The Court has wide powers when it comes to non-compliance with the duty of disclosure. The following consequences can be imposed by the Court:<br><br><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Ordering the party in breach of their disclosure to pay costs to the other party.<br><br><\/li>\n\n\n\n<li>The Court can make an Order for further or specific documents to be provided.<br><br><\/li>\n\n\n\n<li>Punishing a party for contempt.<br><br><\/li>\n\n\n\n<li>Staying or dismissing all or part of the proceedings.\u00a0<br><br><\/li>\n\n\n\n<li>Taking into account the failure to disclose when making an Order for the alteration of property interests. This could lead to a more favourable outcome for the party that complied with its disclosure obligations.<br><br><\/li>\n<\/ol>\n\n\n\n<p>In the most serious cases, the Court may impose a fine or sentence a party to a term of imprisonment.<br><br><\/p>\n\n\n\n<p>If a party is failing to provide disclosure, the other party can ask the Court to issue a Subpoena or make a Search Order. These are options only available to parties who have proceedings before the Court.<br><br><\/p>\n\n\n\n<p><strong><em>Subpoena<\/em><\/strong><br><br><\/p>\n\n\n\n<p>A subpoena is a legal document issued by the Court, at the request of a party to a proceeding, for a person to produce documents or give evidence at a hearing or both.<br><br><\/p>\n\n\n\n<p>In financial proceedings, subpoenas can be issued to third parties such as banks, accountants, businesses, or employers to obtain documents relevant to the proceedings including bank statements, loan records, tax returns, financial statements, and employment records relevant to a party\u2019s financial position.<br><br><\/p>\n\n\n\n<p>Subpoenas can be a powerful tool and should be utilised if a party is failing to disclose certain documents. Subpoenas should not be used by a party as a \u201cfishing expedition\u201d, but rather to obtain targeted information relevant to the proceedings. Where there are no interim applications before the Court, the party seeking to issue a subpoena must seek leave of the Court. \u00a0\u00a0<br><br><\/p>\n\n\n\n<p><strong><em>Search Order<\/em><\/strong><br><br><\/p>\n\n\n\n<p>A Search Order (formerly known as an Anton Piller Order) is an urgent Court Order allowing a party to enter premises to search for, seize and preserve evidence.<br><br><\/p>\n\n\n\n<p>This is a remedy available from the Court, generally as a last resort, when there is a real, immediate risk that a party will destroy, hide, or remove evidence such as financial documents, and\/or where there is a significant lack of transparency regarding a party\u2019s financial circumstances.<br><br><\/p>\n\n\n\n<p>The 2025 ex tempore decision of the Honourable Justice Parker in the case of <em>Fujimori &amp; Fujimori (No 2) <\/em>[2025] FedCFamC1F 438 (<strong>Fujimori<\/strong>) summarised and applied the relevant test to make a Search Order, as originally set out in the case <em>Talbot &amp; Talbot <\/em>[1994] FamCA 129 (<strong>Talbot<\/strong>), and subsequently codified in rule 5.20 of the Rules.<br><br><\/p>\n\n\n\n<p>The Rules provide that the Court must consider and be satisfied of the following matters when making a Search Order:<br><br><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>The person seeking the Order (<strong>applicant<\/strong>) has a strong prima facie case on an application for final orders; and<br><br><\/li>\n\n\n\n<li>The potential and actual loss and damage to the applicant will be serious if the Search Order is not made; and<br><br><\/li>\n\n\n\n<li>There is sufficient evidence that:<br><\/li>\n<\/ol>\n\n\n\n<ol style=\"list-style-type:lower-alpha\" class=\"wp-block-list jds-p50\">\n<li class=\"jds-p50\">The respondent possesses key evidentiary material; and<br><br><\/li>\n\n\n\n<li class=\"jds-p50\">There is a real possibility that the respondent may destroy the material or cause it to be unavailable for use in evidence in a proceeding or anticipated proceeding before the Court.<br><\/li>\n<\/ol>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><br>The facts in Fujimori as they related to the issue of the Search Order were as follows:<br><br><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>The husband was self-employed in information technology, and his business had evolved into the area of blockchain technology.<br><br><\/li>\n\n\n\n<li>The wife had consistently maintained that the husband had failed to comply with his duty to provide full and frank disclosure. This failure included disclosure of documents relating to cryptocurrency.<br><br><\/li>\n\n\n\n<li>The wife had incurred significant expense in bringing applications and implementing other measures, such as subpoenas and investigators, to address the husband\u2019s non-disclosure.<br><br><\/li>\n\n\n\n<li>The wife claimed that towards the end of their relationship, the husband routinely wore a lanyard around his neck which had USB\u2019s, swipe cards and a fob device for banking attached. The husband also carried a hard drive, an iPad and a laptop with him.<br><br><\/li>\n\n\n\n<li>The wife claimed that the husband had told her that he was able to delete, remove or hide documents and information on computers should he need.<br><br><\/li>\n\n\n\n<li>The wife\u2019s solicitor had filed an affidavit detailing the information they had obtained by way of subpoena and investigations. The information they had obtained included undisclosed cryptocurrency exchange platforms and significant undisclosed transactions involving cryptocurrency.<br><br><\/li>\n\n\n\n<li>The wife engaged Mr HH, a digital forensic investigation specialist, who provided evidence that the Search Order was necessary to determine where the cryptocurrency may be located.<br><br><\/li>\n\n\n\n<li>The husband\u2019s failure to make proper discovery was evidence that he could not be trusted to produce all relevant documents and was an indicator that the husband may destroy the material or cause it to become unavailable.<br><br><\/li>\n<\/ol>\n\n\n\n<p>Consequently, Justice Parker was satisfied that the wife had established the necessary circumstances and made Search Orders against the husband and the occupants of his residential address and ordinary place of business.<br><br><\/p>\n\n\n\n<p>Search Orders are a valuable remedy available in matters where there is a risk that a party will tamper with financial documents, or where one party is obstructing a transparent exchange.<br><br><\/p>\n\n\n\n<p>If you would like advice regarding financial disclosure in family law proceedings, including advice about Subpoenas and Search Orders, please contact us on (03) 8762 5222 to arrange an appointment with one of our experienced family <a href=\"https:\/\/www.blackwoodfamilylawyers.com.au\/team.htm\" type=\"link\" id=\"https:\/\/www.blackwoodfamilylawyers.com.au\/team.htm\">lawyers<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>By Gemma Clover &#8211; Lawyer What is disclosure?
